Article 1 : Scope and Modification

These general terms and conditions of sale apply to all orders placed on the website https://browlash-store.com.

Browlash-store.com reserves the right to adapt or modify these general terms and conditions of sale at any time. In the event of modification, the terms and conditions in force on the day of the order will apply to each order.

Article 2 – Availability of products

Our product and price offers are valid as long as they appear on the site and subject to available stock. Upon receipt of the order, we check the availability of the products.

In the event of unavailability, the customer will be informed promptly. They may choose between:

  • delivery of an equivalent product,
  • waiting for restocking,
  • or a full refund of the unavailable product.

If the order contains several products, the available items will be shipped and only the unavailable products will be refunded or replaced.

Article 3 : Validation and Electronic Signature

Any order form signed by the consumer by means of a "double click" constitutes an irrevocable acceptance which can only be challenged within the limits provided for in these general terms and conditions of sale.

The "double click" associated with the authentication and non-repudiation procedure and the protection of the integrity of messages constitutes an electronic signature (law of 13 March 2000). This electronic signature has the same value between the parties as a handwritten signature.

Article 4 – Prices and rates

The prices of the products shown on the site are indicated in euros, both excluding VAT (excl. VAT) and all taxes included (incl. VAT).

The prices do not include delivery costs, packaging or any other possible charges, which are clearly communicated before the order is confirmed.

Lab Estetik SRL reserves the right to modify its prices at any time. However, the price applied is the one indicated at the time of order confirmation.

Article 5 – Terms of payment

Payment for purchases may be made using the payment methods offered on the site at the time of ordering (bank transfer, PayPal, bank cards, Bancontact, etc.).

5.1 – Bank transfer

In the case of payment by bank transfer, the customer has a period of 7 days to make the transfer. After this period, the order will be automatically cancelled if payment has not been received.

5.2 – PayPal and other secure payments

Payments made via PayPal or other online solutions are processed through a secure banking server. Fees related to PayPal transactions are borne by Lab Estetik SRL.

5.3 – Retention of title

The products remain the property of Lab Estetik SRL until full payment of the order. As soon as the products are delivered to the customer, the risks related to the products are transferred to them.

Article 6 – Delivery and Withdrawal

6.1 – Zones and Timeframes

The products are delivered in Belgium, Luxembourg and France via our partners: Bpost and Mondial Relay.

We undertake to prepare and ship orders within a maximum of 2 to 3 working days. The average transport times (Mondial Relay/Bpost) are 48h to 72h working hours after dispatch.

In the event of exceptional circumstances (strikes, weather, force majeure), the customer will be informed of a new estimated timeframe.

6.2 – Right of withdrawal (14 days)

In accordance with Articles VI.47 et seq. of the Code of Economic Law, the consumer has a statutory period of 14 calendar days from the receipt of the products to exercise their right of withdrawal.

To do so, they may use the standard withdrawal form available for download on our website, or send any other clear statement expressing their decision (by email or letter).

The consumer may handle the products in order to verify their nature, characteristics and proper functioning, as they would be able to do in a shop. Any reduction in value resulting from handling going beyond what is necessary may lead to a reduction in the refund, without excluding the right of withdrawal. Where applicable, the applied depreciation will be communicated to the consumer within 48 hours (working days) after receipt of the return.

It is recommended to return the products in their original packaging to facilitate processing, but this is not an obligation.

The right of withdrawal also applies to discounted and clearance products, except for the exceptions provided for in Article VI.53 of the Code of Economic Law.

Return costs are borne by the consumer.

The refund is made within 14 days following receipt of the returned products or proof of their shipment.

Article 7 – Liability

Lab Estetik SRL cannot be held liable for the non-performance or delay in the performance of an order due to a case of force majeure (strikes, disasters, breakdowns, etc.).

For products intended for professional use, we are not liable for indirect damage (loss of business, loss of profit, etc.). The choice and purchase of a product are under the sole responsibility of the customer.

Article 8 – Undelivered parcels / Disputes

If a parcel is returned to us due to an incorrect address (NPAI) or not being collected, reshipment will be at the customer’s expense.

Important : If the parcel is refused due to obvious damage (opened/crushed parcel), please inform our customer service immediately. After verification, a replacement will be arranged free of charge.

Article 9 – Returns and Warranties

Any return must be subject to a prior request to [email protected].

9.1 – Statutory Warranty

The consumer benefits from the statutory conformity warranty of 2 years, in accordance with Articles 1649bis et seq. of the Civil Code (durable electrical equipment). This warranty does not cover normal wear and tear, improper use or lack of maintenance.

9.2 – Returns under the right of withdrawal

In accordance with Articles VI.47 et seq. of the Code of Economic Law, the consumer has a period of 14 calendar days from receipt of their order to exercise their right of withdrawal.

To do so, they may use the standard withdrawal form available on our site (recommended to simplify processing), or send any other clear statement expressing their decision (by email or letter).

The consumer is allowed to handle the products in order to verify their nature, characteristics and proper functioning, within the limits of what would be possible in a shop. If a product shows a reduction in value due to excessive or inappropriate handling, this reduction may be deducted from the refund. The applied depreciation will be communicated to the consumer within 48 hours (working days) after receipt of the return. This reduction in value never excludes the right of withdrawal.

It is advisable, but not obligatory, to return the items in their original packaging in order to facilitate their identification and processing.

The right of withdrawal applies to discounted and clearance items, except for the exceptions provided in Article VI.53 of the Code of Economic Law, in particular:

  • goods made to the consumer’s specifications or clearly personalised;
  • goods liable to deteriorate or expire rapidly;
  • sealed goods which cannot be returned for health or hygiene reasons once unsealed;
  • audio, video or computer software recordings once unsealed;
  • services fully performed before the end of the withdrawal period, with the consumer’s prior express consent.
  • Return costs remain the responsibility of the consumer.

The refund is made within 14 days following receipt of the return or proof of its shipment.

Article 10 & 11 – Data & Resale

GDPR : Your data is processed in accordance with the General Data Protection Regulation. You have the right to access and rectify your data by contacting us.

Resale : The resale of products purchased from Lab Estetik SRL is strictly prohibited on any other website or outside the official network.
