Article 1: Scope and Modification of the General Terms and Conditions of Sale

These general terms and conditions of sale apply to all orders placed on the website reserves the right to adapt or modify at any time these general terms and conditions of sale. In the event of modification, the general terms and conditions of sale in force on the day of the order will be applied to each order.


Article 2: Product Availability

Our product offers and prices are valid as long as they are visible on the site,within the limits of available stocks. Upon receipt of your order, we check the availability of the product(s) ordered.
In case of unavailability,we undertake within 30 days from the validation of the order either to deliver the product ordered, or to offer you a similar product at a similar price, or to reimburse you if the amount of the product is greater than €300 or in the form of a purchase order if the amount of the product is less than €300. In the case of the issuance of a purchase order,you can on request from our Customer Service request the cancellation of it ,by phone or by simple mail (however, for more security, we advise you to proceed to a letter with Acknowledgement of Receipt) to the following address:

Article 3: Order validation and electronic signature (law of 13 March 2000 on electronic signatures)

Any purchase order signed by the consumer by "double click" constitutes an irrevocable acceptance which can only be called into question within the limits provided for in these general terms and conditions of sale.

The "double click" associated with the authentication and non-repudiation procedure and the protection of the integrity of messages constitutes an electronic signature. This electronic signature has the same value between the parties as a handwritten signature.


Article 4: Prices - Prices

The prices appearing on the site are prices excluding tax in euros. The prices indicated do not include the costs of order processing, transport and delivery provided that they take place in the geographical areas provided below.



4.1 - General

poshlashes.be reserves the right to change its prices at any time but undertakes to apply the rates in force that will have been indicated to you at the time of your order.

Article 5: Payment Terms and Security

Payment Terms
You can make the payment:

by bank transfer:You have a period of seven (7) days to send us your transfer to our account , the order is automatically cancelled if the payment is not received and this period is exceeded.

Your order is then booked for 7 days. Beyond this period, without receipt of your transfer , it will be canceled.

Payment by Paypal is made via a secure bank server.
We cover transaction costs.

Retention of title clause
The products remain the property of Poshlashes.be until the complete receipt of the order. However, from the receipt of the order by the customer, the risks of the goods delivered are transferred to the customer.

Payment Default

The website reserves the right to refuse to make a delivery or to honour an order from a consumer who has not fully or partially settled a previous order or with whom a payment dispute is being administered.


Article 6: Delivery terms and delivery times in Belgium

The online sale of the products and services presented on the site is reserved for buyers who reside in Belgium

6.1 - Terms and Conditions
General
The products are delivered to the delivery address you gave us during the ordering process.
For parcel tracking reasons, we are unable to deliver orders to the bases or other premises of the Armed Forces.

6.2 - Shipping times

All announced deadlines are calculated in working days.
The times indicated are average times and correspond to the processing, preparation and shipping times of your order (ex warehouses).
They run as soon as the order is validated * .
To this period must be added the delivery time of the carrier (Post // BPOST // Mondial Relay).

Any item available in stock is shipped within 48 to 96 hours.
In all other cases, availability may vary between 3 and 30 days depending on the type of products ordered.

6.3 - Delivery times

Delivery Method


If the products need to be returned to us, they must be the subject of a return request to our Customer Service (see Article 9):
within 7 days of delivery for a withdrawal, within 15 days for defect or if you did not receive the correct reference
after manifestation of the customer and verification of the hidden defect.
Any complaint made outside this period cannot be accepted.
For a withdrawal or if you did not receive the right reference,
the return of the product can only be accepted for products in their original condition (packaging, accessories, instructions).


Article 7: Responsibilities
The website cannot be held responsible for the non-performance of the contract concluded, due to the occurrence of an event of force majeure and in particular in the event of a total or partial strike by the postal services, carriers, and disasters caused by floods or fires.
With regard to products purchased to meet business needs, the website will not incur any liability for any consequential damages arising hereunder, operating loss, loss of profit, damages or costs, which may arise.
The choice and purchase of a product or service is the sole responsibility of the customer.
The total or partial impossibility of using the products, in particular because of incompatibility of the equipment, cannot give rise to any compensation, reimbursement or questioning of the responsibility of the website, except in the case of a proven hidden defect, non-conformity, defect.
In the event of non-delivery of an order or part of an order, you have a maximum of six months (from the date of departure from our warehouses) to come forward. Beyond this period, we will not accept any claims.



Article 8: Processing of parcels not distributed by the service provider

These are packages that have not been delivered to the final recipient for the following reasons: NPAI, unclaimed, refused, transport damage, spoliation...

8.1 - Returns under the NPAI reason

General
These are the parcels returned by the delivery service provider under the mention: Does not live at the specified address.

Processing an NPAI return

After receipt and acceptance of your package by our services, depending on the nature of the product, available stocks and according to your wish,
we will offer to reship the product originally ordered or an exchange product with equivalent characteristics at your expense.

8.2– Returns under the "refused" reason

You refused your package at the time of delivery because it had obvious signs of opening and/or shocks
After receipt and acceptance of your package by us, a reshipment will be scheduled with you.

Article 9: Right of return
9.1 - Return procedure and general conditions

For the purpose of identification and therefore optimal processing of returns, any product that needs to be returned must be the subject of a return request to our services, otherwise it will be refused. The time you are allowed to contact your customer service depends on the reason for return; please refer to points 9-2 et seq. of the GTC.

Upon receipt of the agreement, you have 15 days to return the product to us. After this time, your return will be refused. We advise you to make the return by tracked parcel. Otherwise, if the parcel, sent by you, and returning to our services, did not reach us, you would not be able to launch a survey with the postal services to ask them to locate it.
Please note that any package not shipped by us is not our responsibility. Only the sender of the parcel is able to launch a survey with the postal services.
In order to properly process your request, please remind us of your order number and full contact details.

Please note: Upon receipt, our services will check the conformity of the returned product and the reason for return. If the returned product does not comply,it will be refused by our services and will be reshipped to you, at your expense. If your return is made under the wrong reason, your product may be refused and therefore be sent back to you at your expense. In particular, the reason for return may be reclassified. From then on, you will be informed by email and the processing of your return will therefore depend on the new reason.

Below you will find the procedure to follow regarding the return of your package. Please follow this procedure so that our services can process your request. Otherwise, your package will be refused:
Carefully prepare and protect your package: Please carefully protect the original packaging of your package and do not write anything on it. In the event of a withdrawal, if the product has a protective label on the packaging, please do not tear it or try to open the packaging (return may be refused, see our GTCs). Please return the entire original package. Attach with your parcel a letter with your exact contact details, and recalling your order number with the reason for return.

Reserve:
The website reserves the right to refuse the package, refund or exchange, if the aforementioned return conditions are not respected . Upon receipt of this product we will process your return in order to respond as quickly as possible to your wishes.


9.2- Returns for withdrawal

Return Terms
In accordance with Article L.121-20 et seq. of the Consumer Code, you have a period of 14 working days from the date of delivery of your order, to return any item that does not suit you, in its original packaging and in good condition, suitable for its re-marketing and request the exchange or refund without penalty, with the exception of return costs. So you have 14 days to let us know that you want to withdraw.

CAUTION: No withdrawal will be accepted if the returned product is unsuitable for re-marketing. Therefore: - The product must be returned in perfect condition, in its original packaging, unopened, unsealed, undamaged, unmarked.
Otherwise, the product will be returned to you, at your expense.

Specific conditions for exercising the right of withdrawal
Returns will not be accepted if the return request is out of time and/or if the original packaging has been decellophaned, unsealed, opened, torn, marked...
Discounted and destocked products will not be taken back or exchanged; except in the case of hidden defects.
Processing of your return for withdrawal After receipt and acceptance of your package by our services, depending on the nature of the product, available stocks and according to your wish, we will offer to reship an exchange product of equivalent value.

Return costs in the event of withdrawal remain the responsibility of the customer.

Article 11: Provisions of the law "Informatique et Libertés"

At any time, "you have a right of access, modification, rectification and deletion of data concerning you (art 34 of the law" Informatique et Libertés "of January 6, 1978).
